The Tribunal is a quasi-judicial body authorized to hear final level appeals from both workers and employers on compensation claim matters. The Tribunal operates independently from the Yukon government and the Yukon Workers' Compensation Health and Safety Board.

The Tribunal:

  • examines, inquires into, hears, reviews and determines decisions made under the Workers’ Compensation Act. Exclusive jurisdiction includes the power to determine:
    • whether a worker’s injury was work-related;
    • the duration and degree of a work-related injury;
    • the weekly loss of earnings of a worker resulting from a work-related injury;
    • the average weekly earnings of a worker;
    • whether a person is a member of the family of a worker;
    • whether a person is a dependent;
    • whether a person is a worker, and to deem a person to be a worker; and
    • whether a worker or a dependent is entitled to compensation.
  • makes rules relating to conflict of interest and conduct of appeal proceedings; and
  • reports annually to the Minister with respect to the number of appeals heard, resolved and pending and activities of the Tribunal.

The Tribunal is appointed by the Commissioner in Executive Council and consists of:

  • 2 members representative of employers
  • 2 members representative of workers
  • 1 member who is the Chair

The Commissioner in Executive Council appoints an alternate member to act as Chair during the absences.

For the purpose of making appointments the Minister must consult with:

  • employers and employer organizations about the appointment of members representative of employers;
  • worker and worker organizations about the appointment of members representative of workers; and
  • employer and worker organizations about the appointment of the chair and alternate chair.

Appointment process: Order in Council

Requirements: Members can't be a member of the Workers' Compensation Health and Safety Board or the board of directors at the same time.

Term: Not exceeding 3 years. Eligible for reappointment.

Meetings: Monthly business meetings and hearings are held as required.
