Mandate

The Board provides an arm’s length forum for reviewing municipal actions and provides an avenue for public input. The Board hears appeals and advises the Minister of Community Services in the areas of planning and municipal boundary changes.

The Board has jurisdiction under the Act specifically:

  • to make recommendations on a proposal for the formation, dissolution, or alteration of boundaries of a municipality;
  • to act as the board of negotiation under the Expropriation Act for land expropriated by a municipality;
    if requested by a council, to make recommendations on a proposed official community plan or amendments thereto;
  • to hear an appeal from a decision of council on an application or plan of subdivision; and
  • to perform any other duties the Commissioner in Executive Council may delegate to it under the Act.

Membership

The Commissioner in Executive Council appoints the following members:

  • 1 Chair;
  • 1 Deputy Chair;
  • 1 member and 1 alternate from people nominated by the Association of Yukon Communities;
  • 1 member and 1 alternate from people nominated by the Council for Yukon First Nations; and
  • 1 member and 1 alternate nominated by the Minister

Appointment process: Order in Council

Requirements: Members must swear or affirm an oath of office as prescribed. A person is not eligible to become or remain a member of the Board if the person is an employee or an officer of a municipality, is an employee of the department of the Minister, is a member of a municipal council or an elected member of another level of government, or while a member of the Board, takes part in any proceedings of the Board if the member has a direct or indirect pecuniary interest in the matter the Board is considering.

Term: 3 year term and eligible for reappointment.

Meetings: The Chair calls meetings as needed.
